Terms and Conditions

These terms and conditions (the “Program Terms and Conditions”) govern the Magic Hands Car Wash Membership (the “Membership” or “Magic Hands Membership”) operated by Magic Hands Car Wash (the “Company”). By becoming a member (“you” or a “Member”) and receiving benefits of the Membership, you agree that you have read, understood, and accepted these Terms and Conditions. These Terms and Conditions supersede all previous terms and conditions of the Magic Hands Membership.

As a member, you understand that the credit card provided will be charged. You authorize the Company or its agent to charge your credit card account for the amount of the membership fee. No further notification of such charges will be provided.

You understand that you may NOT cancel your membership and you shall not receive a reimbursement of any kind if you choose to do so.

Qualification

The club is open only to individuals who are residents of Florida and are at least

18 years old at the time of registration and who provide valid and accurate personal information and a valid and accurate credit card, cell phone number and email when enrolling in the Magic Hands Membership. Individuals under the age of 18 are not eligible. Corporations and other entities are not eligible. All information provided by you must be valid and accurate and must be kept current. Physical vehicle limitations may apply. Only one vehicle per account is allowed, different accounts cannot be combined, and no joint accounts are permitted. Unlimited Program accounts and benefits are non-transferrable.

Membership, Registration & Fees

To enroll in the Magic Hands Membership, you must download the “Magic Hands Car Wash APP” and register your vehicle. You must provide all the required information on the application, including but not limited to the Make, Model, Color and License Tag of your vehicle. Once License Tag is added to a plan, they cannot be changed via the APP.

The characteristics of the vehicle that is registered in the application are subject to the company’s approval. Any changes to the vehicle’s characteristics can only be changed via the administration and in their sole discretion.

The Make and Model of the registered vehicle can only be changed via the administration and in their sole discretion.

Fees are determined by the Membership plan you select, which will be identified in your application materials.

Each account shall have a unique QR, which cannot be transferred. The QR code can be suspended if Magic Hands determines that the Member has misused the services.

Only the vehicle registered with your Membership account are eligible for the membership and it must have a QR Code.

‌Benefits

Membership provides car washes* for your qualifying registered vehicle during regular business hours at the Magic Hands location. Magic Hands reserves the right to alter hours of operation or limit services at any time and for any reason, for example and without limitation, preventive maintenance, repairs, inclement weather, and holidays.

Wash details are determined by the wash plan you select.

Once services are scheduled via the Magic Hands APP they cannot be cancelled or modified on the APP. Once a time slot has been selected and confirmed by user, it cannot be modified on the APP.

‌Cancelling Membership

Membership may not be canceled by the Member at any time. Membership will expire at the end of the Plan term. Members that wish to continue must apply for a new plan on the APP.

The Company may, in its discretion, suspend your benefits, or cancel your membership account, at any time with immediate effect and without written notice in instances where Company believes that you have (i) acted in a manner inconsistent with applicable laws or regulations, (ii) a credit card charge is

declined by the card processing system or you otherwise failed to pay Company amounts due, (iii) acted in an inappropriate, fraudulent, abusive, or hostile manner, (iv) breached or violated any of these Terms and Conditions, or (v) engaged in any misconduct or wrongdoing in connection with the Magic Hands Membership. Nothing contained in these Terms and Conditions will limit the Company in the exercise of any legal or equitable rights or remedies.

Upon cancellation or termination of your membership for any reason, all unredeemed benefits will be forfeited, and you will no longer be able to participate in the Magic Hands Membership and the Company will not compensate or pay cash, cash equivalent, or credit for any forfeited or unused benefits. Whether you may re-enroll in the Magic Hands Membership after a termination is at Company’s sole discretion.

‌Modification & Termination of Unlimited Program

Any Membership change requests must be done directly with the administration and cannot be made through the Magic Hands APP.

The Company may change the Membership and associated benefits for any reason, at any time, and without notice. Company may make changes that affect, without limitation, processes, benefits, prices, and rules of the Membership. All Magic Hands Membership benefits and services are subject to availability and may be changed at any time without notice.

The Company may terminate the Membership with one month’s advance notice to active members. Company may terminate the on less than one month’s notice if required to do so by applicable law, as determined by Company in its reasonable discretion.

‌Your Personal Information

By entering or providing your mobile number, you will receive mobile notifications, text messages, and phone calls from Magic Hands which may be sent using an automatic telephone dialing system, about your membership, including communication in any changes to terms and conditions of the Membership. Message and data rates may apply. You represent that the mobile phone number you provide is accurate and that you are a current authorized user or subscriber of that mobile phone number. You agree to promptly notify us if you change your mobile phone number or any other contact information you provided to us. By becoming a member and receiving benefits of the Magic Hands Membership, you agree that you have provided consent for the Company and its

authorized third-party agents to process data that is personal to you, and to use and disclose that data to third parties.

‌Miscellaneous

The Magic Hands Membership cannot be combined with other offers. The Company may, from time to time, run promotions or special offers related to the Magic Hands Membership (“Promotions”). The details of any Promotion will be communicated to you by Company or its agents, for example and without limitation, by posting onsite at the Magic Hands location, posting on the Magic Hands APP, and/or by email or text message to you. Promotions will be governed by these Program Terms and Conditions and by any additional terms and conditions of each Promotion.

If you do not accept these Program Terms and Conditions, or any subsequent amendment, modification, or supplement, your sole and exclusive remedy is to terminate your Magic Hands membership. The Magic Hands Membership is void where prohibited by law. Any unspecified expenses related to the enrollment or use of the Membership are solely the member’s responsibility. If a court holds any of these Terms and Conditions unenforceable, the remainder of the Terms and Conditions will remain enforceable. The failure by the Company to act on any breach of the Terms and Conditions by you will not constitute a waiver of Company’s right to act with respect to any future breaches.
